PLEASE READ THESE TERMS OF SERVICE CAREFULLY. These Terms of Service are a legal contract between you and Apex Recycling & Disposal. By signing up for our services, you are agreeing to the following terms and conditions:

Designated container(s) will be provided for your use at your specified service address only. The equipment furnished is the exclusive property of APEX RECYCLING & DISPOSAL, however, Customer acknowledges that it has care, custody; and control of the equipment while at the Customer's location and accepts responsibility for all loss or damage to the equipment (except for normal wear and tear of or for loss or damage resulting from Hauler's handling of the equipment) and for its contents.
Rates for the service vary depending on the cart size, frequency, and location specified in your individual Service Request. Current rates and service options can be found at: https://www.apexdisposalservices.com/residential/trash-recycling. Rates are subject to change with a 30-day prior notification.
Term: The term of this Service Agreement will begin on the date of this Agreement and will remain in effect until the completion of Services, subject to earlier termination or extension with the consent of both parties.
Access & Weight: Customer agrees to provide unobstructed access to the equipment on the scheduled collection day. If the equipment is inaccessible so that the regularly scheduled pick-up cannot be made, Customer will be given a reasonable opportunity to provide the required access; however, the Hauler reserves the right to charge an additional fee for any additional collection service required by Customer's failure to provide such access. Customer agrees not to overload (by weight or volume), move, or alter the equipment and shall use the equipment only for Its intended purpose.
Waste Materials: Hauler will only collect materials defined as solid waste or recyclables. Waste materials specifically exclude, and the Customer agrees not to deposit or permit the deposit in Haulers' equipment or place for collection by Hauler any radioactive, volatile, corrosive, highly flammable, explosive, biomedical, infectious, biohazardous, toxic or hazardous wasted, substance or material as defined by applicable federal, state, or local laws or regulations.
Damage to Pavement: Customer agrees that Hauler will not be responsible for any damage to Customer's pavement, curbing, other driving surfaces resulting from the weight of Hauler’s vehicles providing service at the Customer's location.
Indemnity: Customer agrees to indemnify, defend. and hold harmless the Hauler against all claims, damages, suits, penalties, fines, and liabilities (Including attorneys' fees) arising out of any actual or alleged (a) breach by Customer of the terms and conditions of this Agreement. (b) deposit of any Prohibited Waste in Hauler's equipment, or (c) injury to or death of a person or loss or damage to property that may arise out of Customer's use, operation, or possession of any such equipment.
Excused Performance: Neither party hereto shall be liable for its failure to perform or delay in performance hereunder due to contingencies beyond its reasonable control. including, but not limited to, strikes, riots, compliance with laws or governmental orders, fires, and acts of God, and such failure shall not constitute a Default under this Agreement.
Customer Communication: Customer agrees that the company may use their phone number and email address provided to communicate with them regarding issues related to billing, services, service schedules, rate increases, and other related issues which will affect waste services and programs.
If your service address falls outside of our designated Service Area, you will be notified, and the terms of this Agreement will be considered null and void.
Accepted Waste: Household waste, recyclables, and yard trimmings only. DO NOT place dirt, concrete, or metal in the cart.
Prohibited Materials: Prohibited wastes include fluorescent lights, paint, chemicals, solvents, electronics, propane tanks, medical waste, batteries (rechargeable- lithium Ion), car batteries, etc.
Maintenance: Rinse the inside and outside of the roll cart periodically, or if you are returning the cart.
Prohibited Actions: Do not paint on or around the roll cart. Do not place hot ashes in the roll cart. Damage from paint or hot ashes will result in additional charges.
Relocation: If you move within the River Road/Santa Clara or Eugene areas, notify us to transfer your service to your new address.
Rate Adjustments: Rates may be increased at any time to cover increases in costs related to operations and transportation as well as increases in disposal fees for the waste materials hauled. Rates are subject to change with a 30-day notification.
Payments: Customer agrees to pay for the services and/or equipment furnished by the Hauler in accordance with the charges and rates provided for herein. Payments are due by the 10th of each month. A finance charge computed at the rate of 0.75% monthly (APR is 9%) will be assessed on all unpaid balances of thirty days or more with a $1.00 minimum charge.
Billing Errors: Contact us within 30 days of the bill date to report any errors. Bills are considered correct after 30 days without notification.
Fees & Charges: A $30 fee will be applied for returned checks. If service is stopped due to non-payment, the reinstatement fee of $35 will be charged. Service will not be resumed until all charges and fees have been paid in full. A repossession fee of $70 will be charged on all accounts closed due to non-payment if our trucks are required to remove our containers.
Vacations & Temporary Stops: Customers that will not need service for at least two or more consecutive weeks, must notify our office 24 hours in advance to receive credit.
Missed Service: If your service is missed or you forgot to put out your garbage, contact us to schedule a pickup. In some cases, a return trip charge may apply.
Holiday Schedules: We observe the following holidays: New Years Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day, and Christmas. Service will be one day late for the remainder of the week following these holidays. Collection Times: Residential garbage and recycling receptacles must be placed at the curb by 6:00 AM or the night before your service day. APEX RECYCLING & DISPOSAL is not responsible for any items left within 3 feet of the carts. All containers must be removed from curbside by midnight on your service day.
Extra Garbage: Anything not completely inside the roll cart or next to it is considered extra garbage and will be charged for. This includes roll carts where the lid is not completely closed. It is the customer’s responsibility not to overstuff the garbage container to ensure that material will fall freely out of the container.
Yard Debris Recycling: Curbside yard debris recycling is bi-weekly on the same day as your trash pick-up. Acceptable items include lawn clippings, food waste, leaves, brush, tree trimmings, and branches. Plastic, garbage, dirt, rocks, sod, lumber, or pet waste are not allowed. The cart lid must be fully closed.
EUGENE CUSTOMERS—If your service address is located within the city limits, yard debris pickup is free with your trash and recycling service. We’ll empty your gray cart every other week.
LANE COUNTY CUSTOMERS— If your Service Address is located outside Eugene city limits, yard debris pickup is available every other week for an additional monthly fee.
